Code of Civil Procedure, 1908–Order 9, Rule 7–Trial Court allowed the application of petitioner-defendant under Order 9, Rule 7 but proceeded to post the matter for final arguments–Justification–Once the application under Order 9, Rule 7 had been allowed, the natural consequence would have been opening the defendants evidence too and matter ought to have been posted for his evidence–Directed accordingly.
