Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989–Sec. 3(1)(x)–Conviction–Sustainability–As per prosecution, incident took place in two parts–In the second part, accused persons kept on hurling abuses towards the house of first informant and threatened to harm him when he came out–Abuses were allegedly hurled towards the closed doors of complainant’s house–It cannot be concluded that the appellant abused the first informant intentionally–Testimony of prosecution witnesses was found highly contradictory–Improvement in the version of first informant–Other two co-accuseds were acquitted by disbelieving the testimony–Held, appellant is entitled to be acquitted.
