Motor Driving School Registration Scheme, 2018–Central Motor Vehicles Rules, 1989–Prayer to transfer the licence of motor driving school in favour of the successor of deceased-licensee–Dismissed with the observation that there is no provision in the Rules of 1989 or in the Scheme of 2018–Justification–Approach of licensing Authority cannot be said to be in terms of the equitable principles of law–There is no provision for automatic cancellation of the licence on death of a licensee–It is not the case of respondents that any of conditions of licence had been breached or that the petitioner was not qualified in terms of the Scheme of 2018–Law is silent as to what would be the fate of a licence which was issued totally in accordance with law–Clause 9 of Ccircular dated 27.04.2023 refers the provision of transfer of licence in favour of one of successors /legal representatives–Impugned order quashed and set aside and directed to consider the case of the petitioner.
