Evidence Act, 1872–Sec. 90–Application for drawing the presumption
regarding to rent-note which was old more than 30 years–Rejection of–Justification–Document in question is rent-note and it was produced from the custody of petitioner-tenant–It has been market as exhibit, therefore, it cannot be said that it was brought on record for the first time only–Further, even if the presumption u/s. 90 is drawn, the same shall be subject to objection by the respondents–Held, trial Court ought to have allowed the application.
