Code of Criminal Procedure, 1973–Sec. 436–Applicability of provision–Police filed the charge sheet u/s. 201–Magistrate took the cognizance u/ss. 498-A, 201 & 304-B and in alternative u/s. 302–Earlier, the police had released u/s. 436 as the charge was for only the offence u/s. 201–However, now the cognizance for the non-bailable offence has been taken and Sec. 436 is no more applicable–Magistrate was not bound to extend the bail.
