Penal Code, 1860–Secs. 302 & 498A–Conviction–Medical evidence revealing that it was a case of various injuries of strangulation with associated fractures of right cornua of the hyoid bone–Clinching evidence to show that the appellant was present in the house on the relevant day–He failed to
give explanation in regard to injuries sustained by deceased–Trial Court rightly raised the presumption u/s. 106 of Evidence Act–Appeal deserves to be dismissed.
