Order 27, Rule 5A–Rajasthan Panchayati Raj (Election) Rules, 1994–Rules 85 & 86–Election petition–Application for seeking rejection of plaint on the ground that the petition was filed without impleading the State Govt. as party–Tribunal rejected the application with view that the election officer was impleaded as party without there being any allegation against him–State Govt. has nothing to do with the matter–It could not have been considered as a necessary party–Further, the applicability of provisions of Order 27, Rule 5A does not arise in view of specific provisions of Rule 83–Held, no infirmity, illegality or jurisdictional error is found in the impugned order of Tribunal.
