Hindu Marriage Act, 1955–Sec. 13–Denial from granting the decree of divorce–Appreciation of–Material available on record showing that the respondent-wife was forced to live separately to fulfill the wishes of mother of appellant–Respondent was forced to live separately in term of an agreement which was executed by appellant to avoid the criminal complaint being filed by her–Sufficient material is also available to show that the appellant proposed to give the advertisement in the Smarika of samaj as he wanted to remarry–Denial by respondent-wife to make physical relations during the pendency of Court proceedings cannot be termed unnatural as such refusal was to save the respondent ownself from the future allegations regarding her character and other illegal complications–Held, appellant was rightly denied for the decree of divorce.
