Penal Code, 1860–Secs. 302/304-A/304Pt.-II–Appellant fired from a licenced gun pointing towards the roof and caused injuries to five persons–Act was committed in his son’s marriage function–Deceased were present in order to participate in the marriage celebration–No animosity or intention–However, the appellant can not be allowed to take the shelter of Sec. 304-A as unless the safety lock of the gun was moved forward, the gun wouldn’t go off automatically even if it’s butt was hit by a play-ball–Appellant is liable to be convicted u/s. 304 Pt. II.
