Specific Relief Act, 1963–Sec. 12–Limitation Act, 1963–Art. 54–Limitation for filing the suit is three years and it would start from the date fixed for the performance–Date of execution of sale deed was fixed on 15.06.1990 but there was stipulation that prior to execution of sale deed, certain formalities are required to be performed–It is not evident from the material on record that those formalities were performaed or not by the defendant–Further stipulation that if any obstruction in execution of the sale deed would be there, the time for execution of sale deed may be extended–Therefore, time was not essence of the contract.
