Specific Relief Act, 1963–Sec. 12–Rajasthan Colonisation (Gang Canal Lands Permanent Allotment & Sale) Rules, 1956–Decree of specific performance of sale agreement of land–Appreciation–Land was allotted to father of appellants under the provisions Rules of 1956–Sec. 13 of Rajasthan Colonisation Act prohibits the execution of sale deed, and not entering into the sale agreement–Execution of sale deed was to be stipulated after the due deposit of complete amount of allotment–Plaintiff duly performed the part of his contract and duly deposited the outstanding installments with the State Govt.–However, after the death of allottee-father, appellants refused to honour the agreement–Held, suit was rightly decreed.
