Transfer of Property Act, 1882–Sec. 44–Code of Civil Procedure, 1908–Sec. 96–Direction of Execution Court to hand over the actual or symbolic possession in the execution proceedings–Applicant is in possession of the land and he has 2/3 share in it–He has no grievance against the decree of specific performance for the sale of 1/3 part of the land–Suit for partition is already pending–An specific portion cannot be transferred in favour of purchaser of the land–Symbolic possession has been handed over–If the respondent no. 1 attempts to take the forcible possession of the land, applicant can initiate the appropriate proceedings–Declined to grant the leave to appeal.
