Penal Code, 1860–Sec. 307–Probation of Offenders Act, 1958–Sec. 4–Conviction–Benefit of probation–After the conviction, sentence of petitioner was suspended and he was released on bail on 24.06.1994–He is living in the society peacefully without there being any criminal antecedent–No bar under the law to extend the benefit of probation to convict of above 21 years age–It would be appropriate to extend the benefit of probation to the appellant u/s. 4 of the Act–Ordered accordingly.
