Speedy Trial–Framing of charge–Justification–Charge were framed for the offence u/ss. 408, 467, 468, 471 & 120-B–Offence was alleged to be committed in the year 1981-82–FIR lodged in 1985 & charge were framed after 17 years –This delay was not occasioned by accused–His rights of speedy trial recognized under Art. 21 were violated–Further, he has been exonerated from the major charge u/s. 74 of Co-operative Societies Act–Held, proceedings are liable to be quashed.
