Penal Code, 1860–Sec. 302/34–Evidence Act, 1872–Sec. 32–Conviction–Sustainability–Death by burning–No evidence with regard to demand of dowry–witnesses stated that the deceased was short-tempered and she committed suicide–Only evidence of dying declaration–As per statements of Magistrate, deceased was not in a fit condition to depose before him–He admitted that the relatives of deceased were present at the time when he reached to hospital–Witnesses have gone to the extent to say that they asked the deceased to give the statement against the appellants–Dying declaration losses its importance–It would be appropriate to acquite the appellants.
