Mesne profit–Determination–Suit for partition has been dismissed by trial Court with the view that the appellants failed to prove the status/nature of the properties for which the partition was sought–Appellants were in possession of part of property and they were granted indulgence while admitting the appeal–It would be inequitable to deprive the respondent from the right to claim mesne profit–Property is situated in a posh colony of Jodhpur City– Respondent is hold entitled to get Rs. 20,000/- per month as mesne profit from the date of passing impugned judgment.
