Limitation Act, 1963–Arts. 64 & 65–Plaintiff and respondent were coowner of property–During the course of arbitration proceedings, possession of defendant was not adverse possession–Suit was filed by plaintiff when thedefendant declined to carry out the award on 01.11.1942–Property in dispute was specifically allotted to plaintiff–Possession of defendant became adverse possession on 01.11.42–Trial Court hold that the suit was filed within the period of 12 years–However, the property was inherited to both parties by a common ancestor–So the plea of adverse possession was inconsequential.
