Rajasthan Tenancy Act, 1956–Sec. 224–In the second appeal, BOR passed the order of stay and summoned the record–Thereafter, recalled the order with recording the findings that the nature of the land was not in the notice of Court–Once the respondents had put in an appearance before the BOR and they had submitted the objections either about maintainability of the appeal/limitation or any other objection for grant of any interim order, the proper course was to afford the opportunity of hearing to the parties and to hear the stay application–Reasons assigned by BOR for recalling the order are not legally sustainable–Impugned order set aside and BOR is directed to pass the fresh order.
