Code of Criminal Procedure, 1973–Sec. 202 [ Corresponding Sec. 225 of BNSS, 2023 ]–Magistrate took the cognizance on the protest petition–Two accused were residing out side the jurisdiction of the Court–They were also summoned without following the proper procedure, violating the territorial and procedural safeguards–Such lapses amount to defiance of mandatory procedure contemplated in Cr.P.C.–Order of taking cognizance is manifestly illegal.
