Penal Code, 1860–Secs. 419, 420, 465, 467, 468, 471, 120-B [Corresponding Secs. 319(2), 318(4), 336(2), 338, 336(3), 340(2) & 61(2) of BNS, 2023] –Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022–Secs. 3 & 10–Allegation that the petitioners used the unlawful means in a public examination–Case of forged degrees and appearing of the dummy candidates in examination–Allegation pertains to forgery of educational credientials, impersonation and conspiracy which implicate the integrity of the public employment system–Though the petitioners were not named in FIR, their names were justifiably introduced post-investigation under safeguard of due process–Their alleged abscondence and non-cooperation further detracts from any case of mala fide prosecution–SOG has drawn certain conclusions after investigation–Investigation of case shows that the accused petitioners maintained internal connections with an individual affilated with the university concerned who for pecuniary benefit, faciliatated the procurement of a fabricated degree certificates–Existence of evidence–Declined to quash the FIR–Petitioners are directed to extend their cooperation with the ongoing investigation.
