Declaration & Permanent Injunction–Suit for–Maintainability–Plaintiffs have sought the relief of declaration in the representative capacity that the possession of the suit property be delivered to the State–Earlier, the appellant/defendant no. 1 had filed the suit for permanent injunction in respect of the same subject property alleging that he purchased the land through the regd. sale deed and to the north and east of the suit property, there was an open field belonging to Govt. High School, there was a likelihood of the suit property being encroached by them–The suit was decreed and the appeal filed by the State thereagainst was dismissed–Decree of permanent injunction granted in favour of appellant became final–Respondent no. 2-State is bound by the terms of that decree–Further, the plaintiffs in this suit were not the parties to the previous suit and they made no attempt to implead themselves therein having complete knowledge–They have no locus standi to file the present suit, specially in representative capacity–Suit cannot be held maintainable.
