Perpetual & Mandatory Injunction–Suit for–Decreed by the First Appellate Court–In second appeal, High Court held that the suit for mere injunction is illegal in the absence of a prayer for declaration by the plaintiff–Justification–The reasons for a lesser extent of the purchase of the land is that the land originally purchased by the seller was affected by road widening–Commissioner’s report clearly identified the property–The continuous possession of the plaintiff has not been disbelived by the High Court–In the absence of a legal and valid document, defendants cannot resist the plaintiff’s claim–Non-suiting the plaintiff on the ground assigned by the High Court is not sustainable–High Court committed error in deciding the findings of facts which do not suffer from perversity or misreading of evidence.
