Motor Accident Claims–Compensation–Enhancement–Case of 60% permanent disability–Award of Rs. 11,23,000/- in the head of loss of income–High Court enhanced it up to Rs. 27,21,600/- –Plea of petitioner that the amount in this head ought to be enhanced up to 64,80,000/- by taking the multiplier of 18–Held, High Court rightly adopted the settled position of law in assessing the notional income and subsequently enhancing the loss of income of the petitioner after considering his disability 60% but it utterly failed in delving into the aspect of correctness of compensation granted under other heads by MACT–Despite the doctor’s medical opinion, Tribunal did not grant the compensation for the recommended period of time which would have been sufficient for the petitioner–MACT also neglected the fact of uncertainty as to the period of recovery–These facts were not considered by the High Court –Amount of total compensation deserves to be enhanced up to Rs. 48,00,000/-.
