Bharatiya Nyaya Sanhita, 2023–Sec. 318(4) [Corresponding Sec. 420 of IPC, 1860]–Rajasthan Public Gambling Ordinance, 1949–Sec. 13–Information Technology Act, 2000–Sec. 66-D–FIR for the offence–Petitioner has been alleged to be involved in operating an online gambling racket–There is no complainant who has come forward alleging deception, nor is there any material suggestive of entrustment or inducement culminating in delivery of property, the invocation of Sec. 318(4) of BNS appears to be wholly misconceived and bereft of foundational facts–FIR extent to offence u/s. 318(4) is liable to be quashed.
