Code of Civil Procedure, 1908–Secs. 115 & 47–Additional evidence at the revisional stage–Permissibility–The revisional jurisdiction u/s. 115 is confined to examine the legality, jurisdictional error passed on the basis of material or material irregularity in the impugned order available before the Court below, and does not permit enlargement of the evidentiary record or introd-aution of fresh material which was not before the Court below–This limitation assumes greater significance where the revision itself arises out of an order passed u/s. 47 CPC, inasmuch as proceedings u/s. 47 are circumscribed to questions relating strictly to the execution, discharge or satisfaction of the decree–Permitting additional documents at the revisional stage would not only amount to allowing the Revisional Court to travel beyond the scope of Sec. 115 but would also indirectly enable supplementation of the execution, which is impermissible in law.
