Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 8/25–Order of framing the charge–Sustainability–No other evidence is available on record linking the petitioner to the contraband found in the possession of the co-accused except the fact that the petitioner is the registered owner of the motor-cycle–Statement of the witness shows that the vehicle was sold to the co-accused but on account of some technicalities, the registration was not transferred–Further, the co-accused R filed the application for interim custody–Mere registration of the vechicle is not enough to infer that the petitioner knowingly permitted the vehicle to be used in the commission of the offence u/s. 8/25–Petitioner is entitled to be discharged.
