Industrial Disputes Act, 1947–Sec. 36(3)–Advocates Act, 1961–Sec. 30 (As notified w.e.f. 15.06.2011)–Scope–Advocates Act is general legislation and would not over-ride the special piece of legislation i.e., Industrial Disputes Act–Despite the Advocates Act having been enacted, the provisions of Sec. 36(3) would prevail–Sec. 36(3) of the Act of 1947 specifically bars a lawyer/legal practitioner to represent the party to a dispute and hence, the said bar would prevail subject to course, to the exceptions as provided in Section 36 itself.
