Code of Criminal Procedure, 1973–Sec. 227 [Corresponding Sec. 250 of BNSS, 2023]–Discharge of accused–When can be permissible ?–If the evidence, which the prosecution proposes to adduce for proving the guilt of the accused, even if fully accepted at the face value, fails to establish that the accused committed the offence, then there exists no sufficient ground for proceeding with the trial and the learned Trial Court, at that stage should discharge the accused.
