Penal Code, 1860–Sec. 141 [Corresponding Sec. 189(1) of BNS, 2023]–Although the accused persons may have assembled at the spot and protested for their rights but this fact alone does not automatically establish the fact of having a common unlawful object–If a person takes to the streets for the sake of their life or happiness, which is integerally linked to their livelihood, it cannot be construed as a piece of evidence of a common object–There is no evidence of violence or threats that could have disturbed public peace and order–Offence u/s. 141 is not made out.
