Bharatiya Nagarik Suraksha Sanhita, 2023–Sec. 483(3) [Corresponding Sec. 439(2) of Cr.P.C., 1973]–Bharatiya Nyaya Sanhita, 2023–Secs. 115(2), 126(2), 324(4), 110 r/w. 190, 352 & 74–Prayer for cancellation of bail–Acceptability–Though the child victim committed suicide after the five days of the incident, the Investigation Officer concluded that he/she was not abeted to commit suicide–Further, the Trial Court has not framed any charge for the offence under the provisions of Protection of Children from Sexual Offences Act–Merely because the allegations are of serious nature, or the child victim was 16 years of age, by itself, would not constitute a ground for cancellation of bail, particularly when, all the relevant material has been considered while exercising the discretion–Interference declined.
