Code of Criminal Procedure, 1973–Sec. 293(2)–Scope–Merely because the report of Government Scientific Laboratory is relevant and admissible and can be used in evidence, it does not mean that it should be accepted ipsi dixit–Discretion of summoning of a witness can be used either suo motu or upon an application filed by prosecution or accused–If the report is used as an incriminatory piece of evidence against the accused, he must be given a chance to challenge the authenticity and the veracity of the report–Right of cross-examination cannot be denied on the ground that the report can be used as evidence without proven by a witness.
