Indian Medical Council Act, 1956–Sec. 17(4)–Indian Medicine Central Council Act, 1970–Sec. 17(4)–Whether the offences under the above provisions are cognizable or non-cognizable ?–Since both Section 15(3) of the Act of 1956 and Sec. 17(4) of the Act of 1970 prescribe a maximum punishment of one year, these offences by operation of law, fall within the category of non-cognizable and bailable offences–Police is not authorized to investigate such an offence without prior approval from the Magistrate–FIR is liable to be quashed.
