Code of Civil Procedure, 1908–Order 14, Rule 12–Plea as regard to maintainability of suit–It is required to be raised in the first instance in the pleadings (written statement)–Then only such plea can be adjudicated by the trial Court on it’s merits as a preliminary issue.
