Rajasthan Public Trust Act, 1959–Sec. 21–Whether the temple in question amounts to public trust or private property–Consideration of–Temple was constructed by Maharani A and M was entrusted it’s seva pooja through a Bhetnama–M executed will in favour of his son in respect of the property of temple–Bhetnama revealing that it was the dedication to diety and not a gift to Mahant M–Further, the plaintiff no. 1 applied for registration of temple as a Public Trust–Though the application was dismissed yet this fact would have no effect–Assistant Commissioner suo motu declared the temple as public trust–Held, order of Assistant Commissioner was perfectly legal.
