Rajasthan Land Revenue Act, 1956–Sec. 136–Appeal against opening of mutation–Allowed by ACM–RAA set aside the order–BOR found the order of RAA based on surmise and conjunctures and set aside–Instant writ petition–ACM had directed to open the mutation on the basis of provisions of Hindu Succession Act–Case of petitioner was based on adoption and will, however, he failed to produce the adoption deed or will–He also admitted in evidence that no adoption ceremony was organised–Further, the original khatedar of land was having two sons–RAA also not considered the aspect as to whether the adoption was possible or not–Held, no interference is required in the impugned order of BOR.
