premeditation has been shown by prosecution–Incident seems to have taken place under sudden provocation–It was started to the stage of a hit to the motor cycle of accused by the deceased–Deceased followed the accused to his residence–Scuffle between both–Accused fired with his licenced gun and caused the death–Held, offence committed by him falls in ambit of Sec. 304 Pt. I–Senentce modified accordingly
