Jaipur Development Authority Act, 1982–Secs. 32 & 34A–Action of issuance of notice and sealing of the premises of the petitioner’s marriage garden–Plea of the petitioner that JDA has wrongly assumed the jurisdiction u/s. 32 & 34A of the Act as he had already obtained the licence from JMC under the Bye-laws of 2011–Acceptability–Provisions of Sec. 17 begin with a non-obstante clause, thereby, conferring over-ridding effect upon the JDA’s control and ensuring that no development is to be undertaken without its approval–Bye-laws of 2011 have a limited operational scope–As per Sec. 92, the provisions of this Act shall have over-ridding effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force–No commercial activity can be carried out on agricultural land unless the same is converted into an appropriate category–No infirmity, illegality or impropriety is found in the impugned order.
