Rajasthan Panchayati Raj Act, 1994–Constitution of India, 1950–Art. 226 –Auction of shops by the Gram Panchayat after eviction of the petitioners–Case of the petitioners that they were given the assurance that the shops would be handed over to them after repairing work–Case of the respondents that the petitioners have concealed the facts of issuance of several notices and filing of the civil suit in which their application under Order 39, Rules 1 & 2, and the appeal against this order have been dismissed–Concealment on the part of the petitioner is apparent on the face of the record–Record of case reveals that the possession of the shops was taken with the help of police authorities–Petitioners played clear mischief by partcipating in the earlier auction proceedings and not submitting the bid amount inspite of being declared as highest bidder–They caused the financial loss to Gram Panchayat and also sought to misuse the judicial machinery for thier ulterior purposes–Petition deserves to be dismissed with a cost of Rs. 25,000/-.
