Penal Code, 1860–Sec. 306 [Corresponding Sec. 108 of BNS, 2023]–Conviction–Sustainability–Over a period of few months, the neighbours were at loggerheads–Victim felt that her tution classes were being disturbed–Appellant’s family also had a grievance about the victim and her family scolding the children of the appellant’s household–Heated exchanges and physical blows were alleged to have been administered by the appellant’s party–Appellant has been acquitted from the offences u/ss. 323, 504 & 506–There was no intention to abet or to cause any member of either family to take their own life–These quarrels occur in everyday life–It cannot be said that there was an instigation on the part of appellant to such an extent that the victim was left with no other option but to commit suicide–Appellant is not guilty for the offence u/s. 306.
