Code of Civil Procedure, 1908–Order 21, Rule 32 & Sec. 39(4)–Scope–When a decree cannot be executed by a Court, which passed the decree by invoking the provisions under Order 21, Rule 38 CPC, than it has no jurisdiction u/s. 39(4) to pass the order of attachment of property either of the judgment debtor(s) or any other person, including objectors–Impugned order dated 20.03.2021, passed in execution application was without jurisdiction and without any authority.
