Rajasthan Urban Area (Permission for use of Agricultural Land for Non-agricultural Purposes and Allotment) Rules, 2012–Rules 3, 4 & 6–Restriction for allotment of the land which is under litigation–Legal aspect–Req-uirementis that whenever any stay or injunction is granted restricting the conversion, there is statutory obligation to make a reference of such restriction in the affidavit which is required to be filed alongwith the application for conversion–In the instant case, there was no stay or injunction existing on the day of first or second affidavit–Petitioner had mentioned the fact of pending litigation–Impunged order itself shows that the petitioner had filed a caveat–Ground invoked for cancellation the patta is unsustainable–Impugned order is quashed and set aside.
