Indian Succession Act, 1925–Secs. 371 & 372–Scope–If a person at the time of his death was residing at a particular place, the District Judge within whose jurisdiction the particular place exists is having the jurisdiction to entertain the application u/s. 372 at the relevant time–Deceased was residing at Tawriwala, Dist.-Jaisalmer–District Judge Jaisalmer has the jurisdiction to entertain the application–Merely because the village Tawariwala has subsequently came under the jurisdiction of District Phalodi, will not disentitle the respondent to prefer the application u/s. 372 before the District Judge, Jaisalmer–Objection of the petitioner was rightly rejected.
