Rajasthan Panchayati Act, 1994–Sec. 19(1)–Election of the petitioner was declared void on the ground of number of children after the cut-off date–Sustainability–While returning the findings, Election Tribunal relied on the Jan Adhar Card and Ration Card produced by the election-petitioner where as discarded the birth certificate produced by the returned candidate–Ration Card and Jan Adhar Card cannot be used as the proof of date of birth–Trial Court erred in discarding the birth certificate solely on the ground that it was issued only three day prior to scrutining of nomination of candidate overlooking the fact that it was duly issued as per Sec. 17 of Registration of Births & Deaths Act, 1969–Impugned order is liable to be quashed and set aside.
