Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Rejection of application–Appreciation of–Suit for partition, cancellation of sale deeds and permanent injunction–Prima facie it is clear that the property was self-acquired property of GK and SD–Father of appellant no. 1 relinquished his share in favour of own mother and he was having no share in it–Trial Court rightly observed that the appellants failed to prove the very basis of claimed share in the suit property–Further, the Trial Court rightly observed that the property in dispute was not the ancestral property–Held, no case is made out for interference.
