Transfer of Property Act, 1882–Secs. 58(c) or 54–Mortgage by conditional sale and a sale with a condition to repurchase–If the sale and agreement to repurchase are embodied in separate documents, then the transactions cannot be a mortgage by conditional sale irrespective of whether the documents are contemporaneously executed.
