Code of Civil Procedure, 1908–Order 7, Rule 11–Family Courts Act, 1984–Sec. 7–Rejection of application–Appreciation of–Suit as regard to declaration of properties between the parties–Plea of petitioner that the suit between the parties of marriage is maintainable only before the Family Court in view of provisions of Sec. 7(1) of the Act and he has already filed a suit before the Family Court–No ground for rejection of plaint has been made out–Rather a case for a stay of the subsequent suit or a case under Order 7, Rule 10 for return of plaint to be presented before the Competent Authority may be raised–Petitioner would be liberty to raise the issue u/s. 10 of CPC.
