Rajasthan Court Fees & Suit Valuation Act, 1961–Sec. 11–Code of Civil Procedure, 1908–Order 7, Rule 11–Issue of valuation of suit requires to be decided prior to the hearing of the suit on merits as contempleted by Order 18 of the First Schedule of CPC –Whatever decision is taken by the Court is to be complied with by the plaintiff–Ground mentioned in Clause (b) & (c) of Order 7, Rule 11 would arise only when the Court directs the plaintiff to correct the valuation within the time fixed and the plaintiff fails or the Court directs payment of insufficient stamp fees within the time fixed and the plaintiff fails–In the instant case, the Court has not issued the direction to respondent to correct the valuation–Therefore, the application under Order 7, Rule 11 was rightly rejected.
