Workmen’s Compensation Act, 1923–Sec. 30–Finding recorded by the Commissioner in regard to the facts that the deceased was working in employment, were disturbed by High Court–Justification–Commissioner have not returned any finding in respect of validity or non-availability of the licence of deceased nor it was the one of the questions framed by the Commissioner–High Court committed error in making the observation on these points–Presence of deceased at the spot, the ownership of the trolley and goods loaded therein, the presence of supervisor of the employer-company and details mentioned in the inquest panchnama point to the aspect of the deceased person being on the roll of employer–Finding recorded by the Commissioner are more probable–Award deserves to be restored.
