Representation of People Act, 1951–Sec. 83(1)(e)–The requirement of filing an affidavit under the proviso to Sec. 81(1)(c) is not mandatory–It is sufficient that if there is substantial compliance–As the defect is curable, an opportunity may be granted to file the necessary affidavit–Though there is no separate and independent affidavit with respect of corrupt practice, the election petitioner has sworn on oath that the paragraphs where he has raised allegations of corrupt practice are true to the best of his knowledge–There is substantial compliance of the requirements of Sec. 83(1)(e)–Application under Order 7, Rule 11 was rightly rejected.
