Code of Civil Procedure, 1908–Sec. 54–While passing the preliminary decree, Trial Court appointed S as the Commissioner for the division of the revenue land–As per provisions of Sec. 54, Collector or any Gazetted Subordinate Officer who is deputed by the Collector is entitled to division the revenue land–Impugned judgment is set aside up to this extent and Trial Court is directed to appoint the Commissioner as per provisions.
